Welcome to Close Your Eyes Photo. By using our website, www.closeyoureyesphoto.com, and booking any of our photography services, you agree to comply with and be bound by the following Terms & Conditions. These terms provide general guidelines for our services. All photography sessions also require a signed contract outlining the full terms specific to your booking.

1. General Terms

These Terms & Conditions apply to all users of our website and all clients booking photography services.

Each photography session requires a signed Photography Agreement (“Contract”), which outlines the specific terms of your booking, including pricing, deliverables, usage rights, cancellation terms, session adjustments, proofing policies, and any other conditions relevant to the selected session type.

Close Your Eyes Photo reserves the right to update or modify these Terms & Conditions at any time. Continued use of the website or services after any changes constitutes acceptance of the updated terms.

These Terms & Conditions serve as general policies applicable to all clients. If any clarification, difference, or conflict arises, the signed Contract will take precedence.

If either the client or Close Your Eyes Photo determines that the selected session type does not match the client’s needs, the session may be adjusted. Any adjustment affecting pricing, deliverables, or service terms will require a new Contract or a signed Contract amendment before services continue.

Clients acknowledge that detailed policies regarding session adjustments, proof delivery, RAW file restrictions, cancellation rules, and usage rights are governed first by the signed Contract and then by these Terms & Conditions where applicable.

2. Booking & Payment

A signed Contract and either a non-refundable deposit or full payment, depending on the session type, are required to secure your session date.

Sessions that do not require a deposit must be paid in full at the time of booking in order to be confirmed.

All payments are processed securely through Pixieset Payments, powered by Stripe.

Any remaining balance must be paid according to the payment schedule outlined in your Contract.

Failure to submit payment as agreed may result in cancellation, rescheduling, or loss of your session date at the discretion of Close Your Eyes Photo.

3. Cancellations, Refunds & Rescheduling

Cancellation and rescheduling policies are detailed in your signed Contract.

All deposits are non-refundable under all circumstances.

Refunds or credits after cancellation are issued solely at the discretion of Close Your Eyes Photo.

No-shows or last-minute cancellations may result in forfeiture of any payments made.

4. Image Ownership & Usage Rights

All images created by Close Your Eyes Photo remain the exclusive intellectual property of Close Your Eyes Photo and are protected by copyright law.

Specific usage rights are confirmed in each client’s individual Contract. The two primary license types referenced in these Terms & Conditions are the  Personal Use License  and the  Branding & Promotional Use License. Any other permitted use must be expressly stated in the Contract.

A Personal Use License  allows the client to use images strictly for personal, non-commercial purposes, including personal social media sharing, personal printing for home display or gifts, and private archiving. Images licensed for personal use may not be used for branding, advertising, promotion, influencer activity, sponsorships, resale, or any monetized or business-related purpose.

A  Branding & Promotional Use License  allows the client to use images to promote themselves or their own brand, including use on personal or business websites, social media platforms, digital portfolios, branding materials, and promotional materials directly related to the client’s individual, professional, entertainment, or brand representation. This license does not permit the sale, sub-licensing, redistribution, transfer, or third-party use of images, nor the use of images to promote third-party products, services, or brands without prior written consent from Close Your Eyes Photo. Clients may not materially alter, sell, license, transfer, or redistribute images for commercial or third-party use without written permission from Close Your Eyes Photo. Standard cropping or resizing for formatting purposes is permitted unless otherwise stated in the Contract.

By booking a session, you acknowledge and agree that Close Your Eyes Photo may use images from your session for portfolio, website, marketing, promotional, social media, and other business-related purposes unless otherwise agreed to in writing and documented in the Contract.

5. Image Delivery & Editing

Final edited images are delivered within  21 business days  after the client selects their proofs, unless otherwise stated in the Contract.

Proofs will be delivered within the timeframe specified in your session Contract.

RAW or unedited images are not provided unless explicitly agreed to in writing.

Editing style and artistic interpretation are at the discretion of Close Your Eyes Photo. Additional edits or revisions may incur extra fees.

6. Late Arrivals

Sessions begin promptly at the scheduled time.

Clients arriving more than  15 minutes late without notice  may receive a shortened session or have the session canceled without refund.

Late arrivals may reduce the number of final delivered images.

7. Force Majeure (Unexpected Circumstances)

Close Your Eyes Photo is not liable for delays or cancellations caused by events beyond our control, including but not limited to:

• severe weather
• illness
• emergencies
• travel restrictions
• natural disasters
• power outages

If such events occur, we will make reasonable efforts to reschedule. If rescheduling is not possible, refunds may be issued at our discretion.

8. Digital Files & Storage

Final images will remain available for download for  60 days  from the delivery date.

Clients are responsible for downloading and backing up their images within this timeframe.

After 60 days, file availability is not guaranteed.

9. Damage to Equipment / Studio Policy

Clients and their guests are responsible for any damage caused to equipment, props, furniture, or studio property during the session.

Close Your Eyes Photo reserves the right to charge repair or replacement fees for damages caused by negligence or misuse.

10. Client Cooperation & Attire

Clients are responsible for arriving prepared and for following any styling or wardrobe guidance provided.

Close Your Eyes Photo is not responsible for wardrobe malfunctions, an unprepared appearance, or styling concerns.

For best results, we recommend changing into outfits on-site.

Clients may bring makeup wipes or touch-up items for freshening up during the session.

11. Right to Refuse Service

Close Your Eyes Photo reserves the right to refuse or discontinue service if a client’s behavior, communication, or conduct is inappropriate, unsafe, disrespectful, or inconsistent with studio policies. In such cases:

• the session may be canceled immediately
• deposits or payments may be forfeited
• Close Your Eyes Photo will have no further obligation to provide services or refunds

12. Limitation of Liability

Close Your Eyes Photo is not responsible for circumstances beyond our control, including weather, emergencies, or technical failures.

If the photographer is unable to complete the session due to illness or emergency, a reschedule or refund will be offered as outlined in the Contract.

Although we take extensive precautions, we are not liable for accidental loss of digital files beyond our control.

13. Privacy Policy

Personal information collected during booking is used solely for communication, scheduling, and service delivery.

We do not sell or share personal information with third parties, except as necessary to process payments or provide booked services.

15. Minors Policy

Close Your Eyes Photo does not photograph minors unless a parent or legal guardian is physically present for the entire duration of the session.

A parent or legal guardian must sign all required consent and release forms before any photographs are taken.

Sessions will not proceed if the guardian is absent or if the required forms are incomplete.

Close Your Eyes Photo may request documentation to verify guardianship.

17. Studio Access & Safety

The studio is located on the  second floor  and is accessible  only by stairs. There is no elevator available.

Clients are responsible for ensuring that they can safely access the studio.

No refunds will be issued for inability to attend or complete a session due to access limitations.

Clients should notify Close Your Eyes Photo in advance if they have concerns about studio access.

18. Retouching & Artistic Style

Close Your Eyes Photo provides editing consistent with its signature artistic style.

Artistic interpretation, color grading, and retouching choices are made at our discretion.

Requests for edits outside our standard style may incur additional fees and may not be possible.

By booking, the client acknowledges that they have reviewed our portfolio and understand our artistic approach.

19. Photography & Recording Restrictions

Clients and guests may not take photographs, videos, or behind-the-scenes recordings during the session unless explicitly authorized.

Unauthorized recording or photography may result in immediate termination of the session without refund.

20. Additional Fees

Additional fees may apply for:

• rush edits
• extensive or advanced retouching
• additional studio time or reshoots
• location permits or travel, if applicable
• props or special setups

Any additional fees will be communicated in advance whenever possible.
