Welcome to Close Your Eyes Photo! By using our website (www.closeyoureyesphoto.com) and engaging with our photography services, you agree to comply with and be bound by the following Terms of Service. These terms provide general guidelines for our services; however, all sessions require a signed contract, which will outline the full terms specific to your booking.

1. General Terms

These Terms of Service apply to all users of our website and clients booking photography services.
A separate Photography Agreement (Contract) must be signed for each session, outlining detailed terms, including rights, deliverables, and obligations.
We reserve the right to update or modify these terms at any time. Continued use of our website and services after changes constitute your acceptance of the new terms.

2. Booking & Payment

A signed contract and a non-refundable deposit are required to secure a session date. The remaining balance must be paid according to the terms specified in the contract.
Accepted payment methods: Credit Cards.
Failure to complete payment as outlined in the contract may result in cancellation or rescheduling at our discretion.

3. Cancellations, Refunds & Rescheduling

The cancellation and rescheduling policy will be outlined in your signed contract.
Deposits are non-refundable under all circumstances.
If a cancellation occurs, any refunds or credits are issued at the sole discretion of Close Your Eyes Photo.
No-shows or last-minute cancellations may result in forfeiting any payments made.

4. Model Release & Usage Rights

All images taken by Close Your Eyes Photo remain the intellectual property of Close Your Eyes Photo and are protected under copyright law.
Clients receive specific usage rights as outlined in their contract, which may include personal or commercial use based on the agreement.
Clients may not alter, sell, or distribute the images for commercial purposes without prior written permission.
By booking a session, you acknowledge that Close Your Eyes Photo may use images from the session for portfolio, promotional, and marketing purposes unless otherwise agreed upon in writing.

5. Image Delivery & Editing

Final edited images will be delivered within 21 business days after the selection of proofs unless otherwise stated in the contract.
Clients will receive proofs for selection within the timeframe specified in their contract.
Close Your Eyes Photo does not provide raw or unedited images unless explicitly agreed upon in writing.
Editing style is at the discretion of Close Your Eyes Photo, and requests for additional edits may incur extra fees.

6. Late Arrivals Policy

Sessions will begin promptly at the scheduled time.
If a client is more than 15 minutes late without prior notice, the session may be shortened or canceled at the photographer’s discretion, and no refund will be issued.
Late arrivals may result in a reduced number of images, and session extensions may not be possible due to scheduling constraints.
The exact policy for lateness will be detailed in your session contract.

7. Force Majeure (Unexpected Circumstances)

Close Your Eyes Photo shall not be held liable for cancellations or delays due to circumstances beyond our control, including but not limited to extreme weather, illness, travel restrictions, natural disasters, or power outages.
In such cases, we will work with the client to reschedule the session. If a reschedule is not possible, refunds may be issued at our discretion.

8. Digital Files & Storage Policy

Final images will be available for download for 60 days from the delivery date.
Clients are responsible for downloading and backing up their images within this timeframe.
After 60 days, Close Your Eyes Photo does not guarantee the availability of files, and re-access to the gallery may require an additional fee.

9. Damage to Equipment / Studio Policy

Clients and their guests are responsible for any damage caused to photography equipment, props, or studio space during the session.
Close Your Eyes Photo reserves the right to charge the client for repair or replacement costs due to damage caused by negligence.

10. Client Cooperation & Attire

Clients are responsible for arriving prepared, following any styling or wardrobe guidelines provided before the session.
Close Your Eyes Photo is not responsible for wardrobe malfunctions, unprepared appearances, or styling concerns.
To maintain quality, we recommend changing outfits on-site to avoid wrinkles, dirt, and sweat on clothing.
Clients should bring makeup wipes if they prefer a natural look or need to freshen up during the shoot.

11. Right to Refuse Service

Close Your Eyes Photo reserves the right to refuse or discontinue service at our discretion in situations where a client’s behavior, communication, or conduct is deemed inappropriate, disrespectful, unsafe, or inconsistent with the values and policies of our studio. This includes, but is not limited to, violations of these Terms of Service or the signed contract. In such cases, any deposits or payments made may be forfeited, and session cancellation may occur without further obligation.

11. Limitation of Liability

Close Your Eyes Photo is not responsible for circumstances beyond our control, such as weather, unforeseen events, or technical malfunctions.
If we are unable to fulfill a session due to illness or emergency, we will offer a reschedule or refund as outlined in the contract.
While we take extensive measures to back up digital files, we are not liable for accidental loss of data beyond our control.

12. Privacy Policy

Any personal information collected during booking is used solely for communication and service fulfillment.
We do not share or sell your personal information to third parties.

13. Governing Law

These Terms of Service are governed by the laws of Harris County, Texas, and any disputes will be handled within the appropriate jurisdiction.
